Terms of Service

1. Acceptance

By creating an account or using peekwise.ai, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

2. What peekwise.ai provides

peekwise.ai is a competitive intelligence platform that collects publicly available review data from third-party platforms, processes it using AI, and delivers plain-English briefings. The specific platforms monitored, AI models used, and features offered may change over time as we evolve the service.

3. Your account

• You must be 13 years or older and able to form a binding contract.
• You are responsible for keeping your login credentials secure.
• One account per person. You may not share, sell, or transfer your account.
• You must provide accurate information when you sign up.

4. Acceptable use

You may use peekwise.ai only for lawful purposes. You may not:

• Reverse-engineer, scrape, or extract data from peekwise.ai's infrastructure.
• Use the service to harass, defame, or harm competitors or any third party.
• Attempt to gain unauthorized access to other users' data or our systems.
• Resell or sublicense access to the service without written permission.
• Use the service in ways that violate the terms of any third-party platform we monitor.

5. Plans and billing

• Subscriptions are billed monthly in advance. Prices are shown at checkout and may change with 30 days' notice.
• Downgrading or cancelling takes effect at the end of the current billing period.
• No refunds for partial months unless required by applicable law.
• Trial accounts have limited features and competitor caps as described on the pricing page.

6. Data and AI outputs

• Review data shown in the app comes from publicly available sources. We do not guarantee its accuracy or completeness.
• AI-generated briefings, themes, and scores are provided for informational purposes only. They are not legal, financial, or professional advice.
• AI models and providers may change. Outputs may vary across model versions.
• You own the business data (competitor lists, configurations) you input. We own the processed insights derived from it.

7. Intellectual property

All software, design, and content in peekwise.ai belongs to us or our licensors. You get a limited, non-exclusive, non-transferable licence to use the service as described in these terms. Nothing here transfers ownership to you.

8. Third-party platforms

peekwise.ai collects publicly available data from third-party review platforms (Google, Yelp, and others we may add). We are not affiliated with, endorsed by, or responsible for the policies of those platforms. Their terms of service govern how their data may be used.

9. Availability and changes

We aim for high availability but do not guarantee uninterrupted service. We may add, remove, or modify features at any time. We will give reasonable notice for changes that materially reduce what you paid for.

10. Disclaimer of warranties

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, or non-infringement. We do not warrant that the service will be error-free or that AI outputs will be accurate.

11. Limitation of liability

To the fullest extent permitted by law, peekwise.ai's total liability to you for any claim arising from use of the service shall not exceed the amount you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

12. Termination

• You may cancel your account at any time via Settings → Danger Zone.
• We may suspend or terminate accounts that violate these terms, with or without notice.
• On termination, your access ends and we will delete your data as described in our Privacy Policy.

13. Changes to these terms

We may update these terms as the service grows. For material changes, we will notify you by email or in-app notice at least 14 days in advance. Continued use after that date means you accept the updated terms.

14. Governing law

These terms are governed by the laws of the jurisdiction in which peekwise.ai is registered. Disputes will be resolved in the courts of that jurisdiction.
